    last name

    I have a question about my baby's last name. As many of you may know, my husband of 3 1/2 years left shortly after we found out we were pregnant. We had been trying to get pregnant for a year. I got tested, he got tested, I took Clomid and it happened. I couldn't be happier, but my husband told me two weeks after we found out, that he didn't want to be married any longer. In Texas the judge will not grant us a divorce until after the baby is born. I'm 19 weeks now and I have accepted the fact that he's gone and I'm going to be a single mom. I wonder what the law is about my baby's last name. If I change my name back to my maiden name, can my baby have my last name? Is this a legal question or just what I put on the birth certificate? Whatever happens, I want my baby and I to have the same last name, and if that means keeping my married name, I will. Although I REALLY want to have my maiden name back. Any suggestions or information?

    In the divorce you can legally change your name back -- I think that you can put whatever last name you want on the birth certificate - since he won't be there.

    My niece's last name has been different 3 times - her mother put her maiden name on the birth certificate .. then later she had her new husbands name on the birth certificate (legal changed it) ... then later, when my niece was old enough and wanted to use her father's last name, they changed it again legally.

    It's up to you. You can give your child any name you like even if it has nothing to do with either of you.

    I believe that you can give your child whatever last name you would like for him to have.
